$100 million Nuclear Verdict

Shiraz A. Ali, a company driver for Werner driving in his own lane going 50 MPH on a divided highway in west Texas when road conditions suddenly worsened. Admittedly, he was driving too fast for the icy conditions. According to federal agents, he should have slowed to 15 MPH.

However, let’s look at the facts of this case. The plaintiff’s automobile, driven by Trey Salinas, lost control, crossed over the 42 foot grassy median, and hit Ali head on. Clearly, Salinas caused the collision. However, a jury awarded $100 million against Werner Enterprises for not properly training their driver to slow down to 15 MPH for icy conditions.
