Grocer fails to train employees
State Supreme Court Rules in Favor of Plaintiff
Melissa Binns slipped and fell at a Nashville, Tennessee Trader Joe’s grocery store when employee Natalie Thompson spilled liquid from pre-packaged tofu and did not warn customers or immediately clean it up.
Melissa filed a wrongful injury claim against Trader Joes asserting among other claims negligent training. Trader Joe’s argued that the negligence claims should be dismissed in lieu of the premises liability claim. During the initial lower court trial and subsequent appeals, including the Tennessee Supreme Court, Ms. Binns prevailed.
