Thomas v. United Fruit and Produce
Reginald Thomas was struck and severely injured by an untrained forklift operator while working for United Fruit and Produce. In addition to receiving worker’s compensation benefits for his job related injuries, he also filed a wrongful injury claim against the company and forklift operator. Through the discovery process, it was found that United Fruit and Produce had failed to train and certify its fulltime employee as required by OSHA 1918.178 industrial truck operations.
